US judge approves settlement with Keller's Bouchon Las Vegas of EEOC sexual harassment case

July 13 (Reuters) - A federal judge approved a settlement in which Bouchon Las Vegas, whose parent is led by Michelin-starred chef Thomas Keller, will pay $2 million to resolve a U.S. government agency lawsuit accusing restaurant managers of sexually harassing female and male employees.
A consent decree between Bouchon and the U.S. Equal Employment Opportunity Commission was approved on July 8 by U.S. District Judge James Mahan in Las Vegas.
Payments will go to eligible workers at Bouchon since 2018.
Bouchon agreed to hire an outside monitor to review its handling of sexual harassment and retaliation complaints and propose improvements. The restaurant will also improve training of management and other employees, and upgrade its internal complaint procedures.
The decree lasts four years. Keller's company, Thomas Keller Restaurant Group, was among the defendants. Keller was not a defendant and not accused of wrongdoing.
A spokesperson for Bouchon said in a statement: "Bouchon Las Vegas is committed to constantly evaluating ways to improve workplace health and welfare initiatives, [and] elected to resolve these nearly decade-old claims to prioritize the well-being of our current employees over protracted litigation.”
The restaurant is located in the Venetian Las Vegas.
Sexual harassment in the dining sector came under greater scrutiny during the #MeToo movement. Those accused of wrongdoing included celebrity chefs Mario Batali and John Besh, and restaurateur Ken Friedman.
The EEOC said misconduct at Bouchon included sexual advances, sexually charged comments and unwanted advances, primarily by men.
It sued on behalf of Carol Zavala, a former hostess who said her manager touched her inappropriately, yanked her arm and caused bruises, and once tripped her because she refused his advances.
Two of Keller's restaurants have three Michelin stars: The French Laundry in Northern California's Napa Valley, and Per Se in Manhattan.
