Zawya - Press Releases: As a result of the joint efforts exerted by the Labor Fund "Tamkeen" with the relevant authorities in intensifying oversight and enhancing cooperation

The monitoring efforts of the Labor Fund “Tamkeen” in cooperation with the Public Prosecution resulted in detecting cases of misuse of support funds, as the First High Criminal Court issued two sentences against defendants in two separate incidents, sentencing them to imprisonment for periods ranging from 5 to 10 years and fines ranging from 5,000 to 50,000 dinars, and punished others with imprisonment for a period of six months and fines ranging from one thousand to two thousand dinars, for what was attributed to them of forgery in an electronic record and submitting incorrect data through the electronic system of the Labor Fund “Tamkeen” and the General Organization for Social Insurance, and forging and using private documents.

The Public Prosecution received reports from the Labor Fund "Tamkeen" and the General Organization for Social Insurance regarding the actions of the defendants. Investigations revealed that the defendants submitted forged documents and false information through the electronic systems of both entities in order to obtain undue support for the wages of their employees and to fraudulently receive unemployment compensation and a lump-sum payment exceeding 88,000 Bahraini dinars. Based on the findings of the investigations and inquiries conducted by the Anti-Corruption Crimes Department of the General Directorate of Anti-Corruption, Economic and Electronic Security, and the conclusive evidence against the defendants, the Public Prosecution ordered their referral to trial. The High Court reviewed both cases and issued verdicts in each, convicting and sentencing the defendants for the charges against them.

The Fund deals with violations that are detected according to their nature, as administrative violations, such as violating the support requirements, regulations and policies in force at “Tamkeen”, are decided in accordance with the regulatory regulations for violations of suppliers and beneficiaries of the Labor Fund projects approved by the Fund through a number of penalties, including the return of funds, or deprivation of obtaining “Tamkeen” support for a specified period or both together, while violations that involve a criminal suspicion, such as illegal employment, manipulation of wages and the like, are referred to the competent authorities to decide on them and take what is necessary, with “Tamkeen” continuing to have the right to impose the aforementioned administrative penalties on them when a decision is issued regarding them by the competent authorities.

The Labor Fund affirms its commitment to strengthening oversight mechanisms to ensure the preservation and protection of public funds and to monitor all violations and abuses that could lead to support being directed to those not entitled to it. The Fund also commended the level of cooperation with relevant and competent authorities, particularly through the direct reporting of any suspicions or violations of the regulations and bylaws adopted in the Kingdom of Bahrain. It emphasized that all cases involving suspected criminal activity – such as fictitious employment, wage manipulation, document forgery, and others – are referred to the competent authorities to take the necessary legal action.
