Tesla Hit With $1 Million FSD Lawsuit In Texas, Owner Blames 'Aggressive And Irresponsible Salesman' Elon Musk: Report

A $1 million lawsuit filed by a woman in Texas has questioned Tesla Inc. (NASDAQ:TSLA) CEO Elon Musk's appointment and retention by the automaker.

Cybertruck On Autopilot Attempts To Drive Off Overpass

On Wednesday, Electrek accessed court filings that showcased Justine Saint Amour, a Texas-based Tesla owner who bought a used Cybertruck with the Full Self-Driving (FSD) package from a Florida dealership last year, alleging that her vehicle on Autopilot attempted to drive off an overpass in Houston before she disengaged FSD and intervened.

Saint Amour was driving on the 69 Eastex Freeway in Houston when her Cybertruck approached a Y-shaped overpass split near 256 Eastex Park and Ride, the report said. While the Cybertruck should have followed the curve to the right, it kept driving straight and collided into the concrete barrier at the edge of the overpass.

Elon Musk In The Mix

The lawsuit also points towards the appointment and retention of Musk, in a move that hasn't been seen in the previous lawsuits filed against the company over its self-driving tech.

The filing alleged that the automaker was negligent in "allowing Elon Musk to override the concerns of engineers at Tesla," referring to some engineers at Tesla reportedly wanting to incorporate LiDAR tech into the self-driving suite.

The lawsuit also alleges that Musk is an "aggressive and irresponsible salesman" making "dangerous design choices" and "overpromising features," while also alleging misleading marketing practices and defective design.

Tesla's Legal Troubles

The news comes as Tesla has had its fair share of legal troubles over the years. Recently, the automaker was sued by parents of a 19-year-old college student, Krysta Tsukahara, who lost her life after she was trapped inside the flaming vehicle due to the Cybertruck's electronic door system following a crash, the lawsuit alleges.

Tesla was also sued by multiple owners in China over its FSD system's capabilities, as well as faced a wrongful death lawsuit over a Model S crash that claimed three lives on New Jersey’s Garden State Parkway. 

Tesla also filed a lawsuit against the California Department of Motor Vehicles (DMV) after the automaker dropped the “Autopilot” term from its marketing activities amid the false advertising row. Tesla was earlier sued by the California DMV over its marketing activities misleading customers.

Price Action: TSLA gained 2.15% to $407.82 at market close on Wednesday, but declined 0.74% to $404.81 during the after-hours session.
